Agreeing to these terms

These Terms of Service form a binding agreement between you and Carlos Alberto Rodriguez Zapata, an individual trading as Brocalai, at Agostaderito #136, Ojocaliente I, CP 20190, Aguascalientes, Mexico. "Brocalai", "we" and "us" mean that person. "You" means whoever is using the app.

By creating an account or using the app you confirm you have read and accepted these terms and the Privacy Policy. If you do not accept them, do not use Brocalai.

What Brocalai does

Brocalai is a nutrition tracking app for iOS and Android. It exists to make logging what you eat fast enough that you actually keep doing it. It does this by:

• Analysing a photo of a meal to identify the dish and estimate its calories and macronutrients
• Reading a product barcode on your device and looking the product up in the Open Food Facts database
• Reading a printed restaurant menu and ranking its dishes against the calories left in your day
• Turning a typed description of a meal into a logged entry
• Calculating personalised calorie and macro targets from the profile you provide
• Keeping a food diary, a weight log, reminders, a home screen widget and a watch companion

Photo, menu and typed analysis are performed by Google's Gemini models. Barcode reading happens on your device; the product lookup that follows requires a connection.

Who may use it

You must be at least 16 years old to use Brocalai. We do not knowingly provide the service to anyone younger, and we will close an account we learn belongs to a child under 16.

You must also be legally capable of entering into this agreement in your country of residence, and not barred from using the service under any applicable law.

Your account

You can sign in with an email address and password, with Google, or with Apple. Whichever you choose, you agree to:

• Give accurate information, and keep your profile up to date so your targets stay meaningful
• Keep your credentials to yourself
• Tell us promptly if you think someone else has got into your account
• Take responsibility for what happens under your account

One account is for one person. We may suspend or close an account that breaches these terms or that we reasonably believe is being used fraudulently.

Free tier and Pro

Brocalai is free to download and gives you a genuinely usable free tier. Pro is a paid subscription that removes its limits.

The daily scan count resets at midnight in your device's timezone. These limits are configured remotely and may be adjusted; if we reduce what the free tier offers we will say so in the app before the change takes effect.

Entries older than the free history window are not deleted. They are hidden from view while you are on the free tier, and they reappear if you subscribe.

Payment, renewal and refunds

• Price. Pro is offered monthly or yearly. The current price in your own currency is shown in the app before you confirm, and that displayed price is the one that binds.
• Renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends.
• Cancellation. Cancel any time from your App Store or Google Play account settings. You keep Pro until the end of the period you have paid for.
• Free trials. If a trial is offered, its length and the price that follows are disclosed before you subscribe. Cancel before it ends and you are not charged.
• Refunds. Apple and Google issue refunds under their own policies. We cannot issue one directly, though we will help you make the case.
• Price changes. We may change the price with reasonable advance notice. An existing subscription continues at its old price until you are notified and the change takes effect.

Nothing here limits the consumer rights you hold under Mexico's Federal Consumer Protection Law, or under the mandatory consumer law of your own country where that applies.

Fair use of the app

Use Brocalai lawfully and as it was meant to be used. You must not:

• Reverse-engineer, decompile or extract the source of the app, except where the law expressly permits it
• Use bots, scripts or scrapers against the app or the services behind it
• Share, resell or sublicense Pro access
• Submit content that is unlawful, or that infringes someone else's rights
• Submit images with the purpose of extracting output unrelated to food and nutrition
• Interfere with the service, or try to reach parts of it that are not yours

Estimates are estimates

This is the most important thing on this page, so it gets said plainly.

• Results vary with image quality, lighting, angle, and how a dish is described on a menu
• A dish the model cannot judge is marked as having no estimate rather than guessed at
• A barcode result is only as accurate as the Open Food Facts entry behind it, which is community-maintained
• Menu ranking is a snapshot taken when the screen opens, against your remaining budget at that moment
• Handwritten and chalkboard menus are best-effort and not supported

Check the label yourself when precision matters. You are responsible for verifying nutritional information before acting on it.

Health disclaimer

Brocalai is a personal tracking tool. It is not a medical device, not a clinical system, and not a substitute for professional advice.

• Targets are produced by the Mifflin-St Jeor equation from figures you report yourself. They are a general starting point, not a prescription.
• If you have a diagnosed condition — diabetes, a metabolic disorder, an eating disorder, or anything requiring managed intake — talk to a doctor or a registered dietitian before letting an app guide your eating.
• Do not use the app's output to replace, delay or disregard professional medical advice.

Your content and ours

What you put in stays yours. Your photos, entries, notes and saved menus belong to you. You grant us only the limited licence needed to store them, process them, and show them back to you, which ends when you delete them.

What we built stays ours. The Brocalai name, the mark, the app's design, code and written content are our property, protected by intellectual property law. You get a personal, non-exclusive, non-transferable, revocable licence to use the app. You may not copy, modify, distribute, sell or make derivative works from it without our written consent.

Privacy

How your data is collected, used, shared and deleted is set out in the Privacy Policy, which forms part of this agreement. It is worth reading properly: it is specific about your food photos, about which third parties process what, and about deleting your account.

Availability and changes to the app

We aim to keep Brocalai running, but we do not promise uninterrupted service. It depends on providers we do not control, and it needs maintenance.

We may add, change or remove features. Where a change materially reduces what a paid subscription gives you, we will notify you in the app, and you may cancel and seek a refund for the unused period through the store that billed you.

Ending the agreement

You can stop at any time by deleting your account in the app. That erases your data permanently, as described in the Privacy Policy. Cancel any active subscription separately in your store account, since deleting the account does not cancel the billing.

We may suspend or end your access if you materially breach these terms, if the law requires it, or if we discontinue the service. Where we discontinue the service we will give reasonable notice and refund the unused part of a paid period.

Sections that by their nature should outlive the agreement — intellectual property, disclaimers, liability and governing law — continue to apply after it ends.

Liability

To the fullest extent the law allows, Brocalai is provided "as is" and we exclude liability for indirect, incidental, special or consequential loss arising from your use of it, including lost data, lost revenue, and health outcomes attributed to reliance on its estimates.

Our total liability for any claim under this agreement is limited to the greater of the amount you paid us in the twelve months before the claim, or 200 Mexican pesos.

Nothing in these terms excludes liability for fraud, for wilful misconduct, or for anything else that cannot lawfully be excluded — including your mandatory rights as a consumer, which are unaffected.

Governing law and disputes

This agreement is governed by the laws of the United Mexican States. Any dispute arising from it is submitted to the competent courts of Aguascalientes, Aguascalientes, and both parties waive any other venue they might otherwise claim.

If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, nor of your right to bring a complaint before PROFECO, Mexico's consumer protection agency, or the equivalent body where you live.

Before going to court, please write to us. Most disputes are a misunderstanding that an email resolves faster than a filing.

Changes to these terms

We may update these terms as the app or the law changes. When we do, we update the date at the top and, for material changes, tell you in the app before they take effect.

Continuing to use Brocalai after the effective date means you accept the new terms. If you do not accept them, stop using the app and delete your account.
